1. Scope, Governing Law, and Jurisdiction
1.1 We, MakCameras Limited, registered at 5 Beechtree Road, Walsall, West Midlands, WS9 9LS, under company number 16133949 (“we”, “our”, or “us”), operate an online platform specializing in the sale and purchase of pre-owned photography and video equipment (“Products”), including accessories.
1.2 These (“Agreement”) Terms and Conditions set out the legal framework governing all transactions and contracts carried out through the https://www.MakCameras.com website (“Platform”) between MakCameras and you, the customer (“Customer”, “you”). This Agreement applies to:
(I) Offers made by you to sell your Products to us (“sell”, “selling”, “sale”);
(II) The general use of the Platform;
(III) The purchase of Products made available on the Platform (“buy”, “buying”, “bought”, “purchase”);
(IV) Trade transactions, where you sell your Products to us in exchange for purchasing others, with potential financial adjustments to reflect price differences (“trade”).
Unless explicitly stated otherwise, this Agreement applies equally to consumers and business customers, in accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
1.3 The Platform is intended exclusively for customers who are at least 18 years old.
1.4 All transactions related to the purchase, sale, or trade of Products are governed by the version of this Agreement in effect at the time of the transaction. Your access to the Platform is also subject to our Privacy Policy and Cookie Policy.
1.5 We do not accept any additional terms proposed by customers. This applies even if we do not explicitly object to such terms.
1.6 This Agreement is governed by the laws of England. Any disputes arising from or in connection with this Agreement shall be subject to the jurisdiction of the English courts. If you are a consumer and reside in a different country at the time of your purchase, the mandatory legal provisions of that country remain unaffected by this choice of law and jurisdiction.
2. User Account Registration
2.1 You may access and use the Platform either as a registered user or without registering for an account.
2.2 If you choose to register for a user account, you agree to:
2.2.1 provide accurate, complete, and up-to-date information during the registration process;
2.2.2 ensure that your details remain correct and promptly update any changes; and
2.2.3 keep your password secure and maintain the confidentiality of your account credentials.
2.3 If a user account is registered on behalf of a legal entity or partnership, it must be created by an authorised individual who must be identified by name.
2.4 We reserve the right to suspend or terminate any user account if we have reasonable grounds to believe that the provided information is inaccurate, incomplete, or misleading, or if we determine that the account is being used in a manner inconsistent with its intended purpose.
2.5 User accounts are strictly personal and cannot be transferred to another individual or entity.
3. Products
3.1 Product Description
3.1.1 Unless explicitly stated otherwise in the product description, the Products we offer are used items. Used Products may exhibit signs of wear, surface marks from previous use, minor defects, or functional limitations that do not significantly impact normal use. These details are outlined in our cosmetic condition descriptions; we strongly recommend reviewing them carefully to avoid misunderstandings. Compared to new items, used Products generally have more wear and a reduced overall lifespan, particularly for mechanical components, batteries, chargers, and certain electronic parts.
3.1.2 We strive to ensure that the images displayed on the Platform accurately represent the actual Products. However, as we cannot control the colour reproduction settings of the hardware and software you use to view our Platform, we are not liable for any discrepancies in how the photographs appear.
3.1.3 If you have any questions or require further information about our Products, you can contact our customer support team via the Contact Us page.
3.2 Product Availability
3.2.1 All Products displayed on the Platform are available for purchase, subject to stock availability.
3.2.2 Any temporary or permanent unavailability of a Product will be indicated on the product detail page or at the time of placing an order.
3.2.3 We reserve the right to modify or discontinue the sale of any Product on the Platform at any time. These changes will not affect orders that have already been accepted.
4. Buy from MakCameras, Orders, Entry into Contract
This clause applies when you purchase a Product from MakCameras. The terms for selling your Product to MakCameras and the selling aspect of trade transactions with MakCameras are outlined in Clause 7.
4.1 Placing an Order
4.1.1 You can place an order by selecting the Products you wish to purchase and following the on-screen prompts.
4.1.2 You can review and correct any input errors in your order up until you submit it by clicking the "Buy" button on the checkout page. Once your order has been submitted, you will not be able to make changes yourself (such as modifying the delivery address). If you need to make adjustments, our customer support team can assist you via the Contact Us page.
4.2 Order Confirmation
4.2.1 Once you have placed an order and payment has been pre-authorised in accordance with Clause 6, you will receive an automated email confirming that we have received your order.
4.2.2 This order confirmation does not constitute a binding acceptance of your order. Your order is considered accepted either when we send you a subsequent confirmation email or when the Product is dispatched, whichever occurs later. The contract between us for the purchase of the Products is formed at that moment.
4.2.3 If you wish to track your order status, you can log into your user account. In case of any issues, you can also contact our customer support team via the Contact Us page.
4.2.4 In some cases, we may be unable to accept an order, for example, if a Product is unexpectedly out of stock, if your delivery address is outside our shipping areas, or if a Product was incorrectly priced due to an error. If this occurs, we will inform you as soon as possible and issue a full refund for any payments made.
4.3 Transfer of Risk and Retention of Title
4.3.1 When you purchase a Product from us, the risk of accidental loss, damage, or destruction of the Product transfers to you upon delivery to you or a designated third party, as outlined in Clause 8.
4.3.2 If you are purchasing as a business trader, the risk of accidental loss, damage, or destruction passes to you as soon as the Product is handed over to the shipping provider or if you fail to accept delivery in a timely manner.
4.3.3 Regardless of delivery and risk transfer, ownership of the Product remains with MakCameras until full payment, including any applicable shipping costs, has been received. Until ownership is transferred, you hold the Product as a fiduciary agent of MakCameras and must store and protect it appropriately.
5. Prices
5.1 All prices displayed on the Platform are fixed prices in pounds sterling (£) and include any applicable VAT.
5.2 Shipping costs are calculated separately and will be displayed in the shopping basket. They will also appear on the order summary before you confirm your purchase. If your delivery is outside the UK and subject to additional customs duties, you will be responsible for covering these costs.
5.3 We strive to ensure that all advertised prices are accurate. However, we reserve the right to refuse a sale if an incorrect price has been published due to an error.
5.4 If you are a business customer, note that most used products are sold under the VAT Margin Scheme, meaning no VAT can be reclaimed.
6. Terms of Payment When You Buy from MakCameras
6.1 Payment must be made in pounds sterling (£) at the time of ordering on the Platform, though only a pre-authorisation of funds is conducted at this stage. The actual payment will be processed when the Product(s) are dispatched. We accept all major credit and debit cards, as well as alternative payment methods displayed at checkout, including PayPal, Apple Pay, and Google Pay. Customers may also opt for payment via starling bank transfer, with bank details available upon request.
6.2 By confirming your order, you guarantee that you have the necessary authorisation to use the selected payment method.
6.3 Orders are processed in compliance with applicable banking security standards. To enhance security for debit and credit card transactions, you must provide the CVV security code from the back of your card for anti-fraud verification. Your card will only be charged once the order has been verified, ensuring that it complies with this Agreement and that the requested Products are available for dispatch.
6.4 To prevent online fraud, details of your order may be shared with legally authorised third parties for verification of your identity, order validity, payment method, and delivery details. We may, at our discretion, request additional information, which you agree to provide to facilitate order completion.
6.5 If you choose to return a Product, MakCameras will not refund any taxes, import duties, customs fees, or other charges incurred during the import process. Some countries allow for reimbursement of customs duties on returned items; we recommend contacting your local authorities or the courier handling your shipment for further guidance.
7. Selling to MakCameras, trading with MakCameras, and Entry into Contract
This clause applies when you sell your Products to MakCameras or trade with us. The terms outlined in this section govern the sale side of your trade with us. If you are also purchasing from us as part of the trade, the buying provisions outlined in Clause 4 apply to that portion of the transaction.
7.1 General Conditions for Selling to MakCameras and the Sell Side of a Trade
7.1.1 You may offer to sell us your used Products if they are currently listed in the range of Products available on our Platform. If a Product is not listed, we may still provide a quote where possible. If we are unable to do so, we will inform you accordingly.
7.1.2 The following conditions apply to any sale to MakCameras, including those conducted as part of a trade:
(I) You must be the legal owner of the Products and have the authority to sell them or include them in a trade.
(II) You are responsible for ensuring that all Products you offer have been legally imported into the United Kingdom. If you originally purchased the Product, we may request a VAT receipt as proof of purchase. If you are a second-hand buyer, we reserve the right to request additional documentation.
(III) We are not obligated to accept any Products from customers, even after they have been sent to us for inspection. Once a contract is finalized in accordance with this clause and payment has been processed, ownership of the Products immediately and irrevocably transfers to MakCameras.
7.2 Quote Request When Selling to MakCameras
7.2.1 To request a quote, click on the "Start Selling/Trading" or "Sell/Trade" menu option on the Platform homepage and complete the quote form with details of the Products you wish to sell. You must provide information about the item, including its type, brand, and model, and specify its cosmetic condition.. Your description of the brand, model, and condition must accurately reflect the Product at the time of the offer. We will use the cosmetic condition rating below to establish an initial valuation. Please note that this valuation may be adjusted following a physical inspection, as outlined in Clause 7.5.1.
7.2.2 MakCameras Cosmetic Condition Categories:
Like New – As if brand new out of the box. No visible signs of use, wear, or imperfections. No scratches, marks, scuffs, or discoloration. The optics are clear and free from dust or defects.
Excellent – Minimal signs of use. Slight wear may be present but barely noticeable. Tiny marks or minor paint imperfections may be visible under close inspection. Optics remain clear, with no significant dust or defects.
Very Good – Moderate signs of use. Noticeable marks, minor scuffs, or slight discoloration may be present. Optics may have minimal dust but no significant impact on performance.
Good – Clear signs of use. More prominent marks, wear on rubber grips, or minor scratches may be visible. Optics may have some dust or minor imperfections that do not affect usability.
Well Used – Distinct wear with visible scuffs, scratches, or worn-out rubber grips. Noticeable dust or small defects in optics may be present but do not severely impact performance.
Heavily Used – Significant wear with heavy marks, deep scratches, or faded parts. The optics may have considerable dust or imperfections, possibly affecting image clarity.
7.2.3 The cosmetic condition you specify when submitting your item information will directly impact the initial quote. However, the final valuation may be adjusted following the physical inspection outlined in Clause 7.5.
7.2.4 If your item includes any original manufacturer accessories (e.g., charger, battery, USB cable, original packaging or any other accessories), they will be factored into the quote. If you include additional non-original accessories, you must list them separately when completing your quote form. If non-original accessories are not listed separately, MakCameras will assume that they are included at no additional value. If an accessory is missing from the package, we will have to adjust the quote accordingly after inspection. Any missing accessories sent separately later will not be accepted or processed, and we are not responsible for additional shipping costs if you send them separately.
7.3 Generation of the Quote, Information and Confirmation of Receipt of Product
7.3.1 Upon receiving your Product details, we will send you an automated email confirming receipt. This email will contain an initial evaluation of the Product and an estimated price that we may offer. It will also include a Transaction ID reference number, which you should use in all correspondence with us.
7.3.2 This email quote does not constitute a binding offer from us. If you agree with the initial evaluation, the Product will proceed to our inspection process for final assessment.
7.4 Delivery of Your Product When Selling to MakCameras
7.4.1 When selling to MakCameras or as part of a trade, we will arrange for a courier to collect the products from your home (or another preferred address), or you can drop them off at an agreed DPD or Royal Mail drop-off location. Customers within the UK qualify for our free courier service when selling to MakCameras or trading in a product.
7.4.2 MakCameras takes no responsibility for any damage or loss of items sent to us via a postal or courier service not designated by us. Customers who choose to send items independently are advised to use an insured and trackable delivery service and keep proof of postage, but they do so entirely at their own risk.
7.4.3 All collections will be booked for one box only, unless otherwise specified by you. If your Products require more than one box or package, you must inform us before the courier is booked.
7.4.4 You must ensure that all required details, including your Transaction ID reference number and the correct courier label supplied by MakCameras, are clearly displayed on the package. Any failure to do so may result in delays or errors when processing your items and may lead to your Product being rejected. MakCameras accepts no liability for damage or loss of items sent without proper labelling.
7.4.5 If the product is not collected due to an error by MakCameras or the courier, we will arrange a new collection date at no additional cost.
7.4.6 If the Products cannot be collected due to a reason attributable to you, such as incorrect address details, no one being available at the collection address, or any other reason causing a failed collection, a £10 fee will be charged for a new collection.
7.4.7 If you are selling your product to us as part of a trade, we will not reserve the items you wish to purchase from us, as stated in Clause 3, until your courier has been booked. We reserve the right to cancel the reservation of the product you intend to buy if the item you are selling has not been collected within 14 days of booking the courier.
7.4.8 When handing over a package to the courier, you must ensure that you receive an authorised proof of collection, either as a printed courier collection slip or confirmation via the electronic courier tracking system. Handwritten confirmation from the courier will not be accepted as valid proof, so you should not hand over the package unless the courier can scan it and provide a printed collection slip.
7.4.9 MakCameras cannot be held responsible if the courier tracking indicates that no collection took place at the address and no authorised proof of collection can be provided for the package(s).
7.4.10 Loss or Damage in Transit
(I) Where you have used the MakCameras-approved courier service and your package is lost or damaged in transit, you should notify MakCameras immediately so that we can open an investigation. You must supply MakCameras with the following information:
The package was received by the MakCameras courier and marked in the tracking system as “collected” or similar. If you drop off the Products at an approved DPD drop-off shop, you should request a receipt as proof of drop-off.
Verified proof of your address and identity.
Evidence of ownership of the item, such as a copy of the original invoice. We may also request photographs taken before shipping to verify the cosmetic condition.
Compliance with all MakCameras processes set out in this Agreement, including correct labelling of delivery items.
Any other information and evidence that MakCameras may reasonably request.
(II) A full investigation by MakCameras may take up to 30 days, provided that you supply all the requested information. The 30-day period starts from the date all necessary information has been received. We will notify you if there is an exceptional reason why the investigation may take longer.
(III) As part of fraud prevention, MakCameras may share information about the transaction with a third-party verification service authorised by law to confirm your identity, ownership of the item, and delivery details. You agree to supply any necessary information to facilitate the investigation.
(IV) If the loss or damage is covered by insurance, MakCameras will notify you.
(V) The determination of the outcome of an investigation under this Clause 7.4.10 by MakCameras is final.
(VI) The maximum amount payable in the event of a successful claim will be the quoted value. No other valuations will be accepted.
(VII) MakCameras will not be liable for any consequential or indirect losses in connection with any claim.
(VIII) Any additional items included by you for purchase or exchange which are not listed in your quote are sent at your own risk.
7.4.11 You must ensure that all Products are fully and securely packaged to withstand reasonable movement and impact during transit. Failure to package Products adequately may affect any insurance claims for damage during shipping. MakCameras will not be responsible for damage caused by inadequate packaging.
7.4.12 To submit a claim for a lost or damaged Product under this clause, please contact MakCameras at Help@MakCameras.com. All claims will be fully investigated by our internal security team, and MakCameras reserves the right to reject any claim at its sole discretion based on the results of the investigation.
7.4.13 MakCameras reserves the right to refuse delivery of any parcel that does not have a valid transaction label attached. If a shipment contains multiple items, each item must have its own transaction label. MakCameras accepts no liability for any package that is lost or damaged without a valid label.
7.4.14 You must not ask MakCameras or our designated courier to transport any items if such transportation would be unlawful. MakCameras and our courier will not accept any products that have not been previously agreed upon for sale or purchase and are not listed in the transaction quote. If you send products that MakCameras has not agreed to accept, you will be liable for any resulting losses or damages. Additionally, you will indemnify MakCameras against all penalties, claims, damages, costs, and expenses arising from the unauthorized shipment. The products may be destroyed or otherwise disposed of at the sole discretion of MakCameras, our designated courier, or any other relevant party.
7.5 Product Review Process
7.5.1 Upon receiving the Product, we will conduct a thorough inspection to verify that it aligns with the description provided by you, particularly regarding its cosmetic condition.
7.5.2 During this inspection, we reserve the right to take the following actions:
(I) Remove third-party accessories such as collars and hoods if they cannot be listed with the Product;
(II) Remove protective films, covers, or screen protectors;
(III) Remove lens coatings and/or filters;
(IV) Remove stickers, personal inscriptions, or addresses;
(V) Dispose of damaged, swollen, or non-functional batteries, as well as batteries with reduced recharge capacity;
(VI) Remove any dirt;
(VII) Dispose of damaged cables and/or chargers;
(VIII) Remove packaging, especially if it is soiled, damaged, or not the original packaging for the Product;
(IX) Remove peripheral items such as memory cards and filters if they are not models that MakCameras can offer to buy;
(X) Remove packing materials;
(XI) Perform other similar actions as part of the checking process;
(XII) Attach a removable sticker or safety labels to relevant places;
(XIII) Open sealed or packaged Products and accessories for testing purposes;
(XIV) Dispose of any accessories that are too damaged to be resold.
These minor changes will not be reversed if the sale is not completed and we return the Product to you.
7.5.3 If the sale is not completed, we reserve the right not to return any item (as described in clause 7.2.4) that was not separately listed in your quote. MakCameras may dispose of such items as it sees fit, including recycling or donating them to charity.
7.5.4 If, after our detailed inspection, we confirm that the product matches the cosmetic condition grade stated in the quote and no adjustments are necessary, we will send you an email confirming our original evaluation. A contract will then be formed based on these pre-agreed terms. We reserve the right to reject any additional item(s) you send after we have completed the evaluation and sent the email confirmation.
7.5.5 If, upon inspection, we find that the actual cosmetic condition of the Product differs from what was stated in the quote, requiring a price adjustment, we may issue an updated quote. In this case, we will contact you by email to inform you of the revised rating. This email will give you the opportunity to either accept or reject the new quote. If you accept, a contract will be formed, and you will not be able to dispute or challenge the adjusted quote. If you reject the new quote, no contract will be entered into, and we will return the Product to you free of charge. If you are responsible for a failed delivery, we reserve the right to charge you for shipping costs.
7.5.6 If we determine that a Product sent by you has been reported stolen or we suspect that it may be stolen, we will immediately notify the police and will not return the item to you.
7.5.7 MakCameras reserves the right to cancel the transaction or adjust the valuation of your product for any of the following reasons, including but not limited to:
(I) If the Product exhibits internal fungal growth, moisture, or dampness;
(II) If the Product is not EU or UK stock;
(III) If MakCameras suspects the Product is counterfeit or non-original in any way;
(IV) If the Product is faulty or shows signs of imminent failure;
(V) If the Product is missing essential components such as batteries or chargers;
(VI) If the Product has signs of impact or other damage;
(VII) If the Product differs in age, usage, or exact model from that stated in the quote;
(VIII) If the Product shows excessive wear not consistent with the cosmetic condition rating in the quote;
(IX) If the Product does not match the description provided.
7.5.8 Payments made to you by MakCameras in connection with a sale or trade are subject to the provisions of clause 14 regarding payment terms.
7.5.9 The following is a general guideline for the estimated time required to complete the transaction. These times are non-binding and are provided for informational purposes only:
(I) When using our free courier service, we typically receive the Product the next working day following collection, unless it is sent from a remote location;
(II) We then inspect the Product as soon as possible. This process usually takes between two and five working days but may take longer;
(III) Bank transfers are processed in batches. Once the Product has been checked and your bank details verified, payment is usually made within three working days. The exact time for funds to clear in your account may vary depending on your bank;
(IV) We will keep you updated regularly via email regarding the progress of the sale or trade.
MakCameras is not responsible for any delays caused by the courier service.
7.5.10 The price offered by MakCameras is the total amount offered for your equipment. If you are liable to pay VAT (and are therefore required to charge VAT on the sale), the offer is VAT-inclusive. If VAT applies, you must notify MakCameras at the beginning of the sale or trade process. In this case, you must also provide a sales invoice at the time of sale, specifying the VAT amount.
7.5.11 If you fail to respond to our communication regarding the return of your Product under clause 7.5.5, we will make reasonable efforts to contact you. However, if three months have passed without any response, MakCameras reserves the right to dispose of your Product as it sees fit, including recycling, donating it to charity, or taking ownership.
7.5.12 Since a trade transaction consists of two separate transactions (one for selling and one for buying), if the purchase of the Product you intended to buy from us does not go through, or if you cancel or return the Product, the Product you sold to us will not be returned. MakCameras is not liable to you in any way for the Product sold to us as part of the trade.
8. Delivery of Products When You Buy from MakCameras
8.1 All orders will be shipped exclusively via DPD or Royal mail and will require a signature upon receipt. MakCameras is not responsible for any delays in delivery, regardless of the cause. We do not accommodate requests for alternative courier services.
8.2 Orders will be delivered to the postal address provided at the time of purchase. It is your responsibility to ensure that the address is complete and correct. We strive to dispatch in-stock products ordered before 4 p.m. on a working day on the same day.
8.3 A signature is required for all deliveries. Once you or a designated third party has taken possession of the product(s) and signed for the order, the delivery will be considered complete. MakCameras accepts no liability for loss or damage if you request the package to be left in a safe place or alternative location.
8.4 You must ensure that someone is available at the delivery address to receive the package. If no signature is provided and no alternative arrangement has been made, the courier will return the package to the local depot. Follow the courier’s instructions to reschedule delivery, which may incur additional charges.
8.5 MakCameras is not liable for lost, damaged, or undelivered parcels or any part of a delivery, unless due to an error on our part. If a product is found to be damaged upon arrival, you must notify MakCameras immediately so that an investigation can be initiated. Any conclusions reached by MakCameras following the investigation shall be final.
9. Returns Policy When You Buy from MakCameras
9.1 You can cancel an order at any time before delivery and up to 14 days after receiving it, starting from the day following the delivery of the complete order. If you cancel, you will be refunded the full purchase price of the product(s) as soon as possible, and no later than 14 days after we receive the returned product(s).
9.2 To cancel an order, you must clearly notify us by emailing Help@MakCameras.com, including your name and order number, or by completing and submitting the cancellation form. Once confirmed, we will provide a returns authorisation number, which must be included with your return. Failure to do so may delay or jeopardise your return.
9.3 To exercise your right under clause 9.1, you must return the Product(s) within 7 days of notifying us of your cancellation. The Product(s) must be in the same condition as received. You are legally required to take reasonable care of the Product(s) while in your possession. If the Product(s) show signs of deterioration due to use, we reserve the right to deduct the cost of depreciation (up to the full price of the Product(s)) from your refund.
9.4 Products must be returned using a trackable and insured delivery service. If a return is due to an error on our part, we will arrange for collection via our nominated courier. In all other cases, you are responsible for return shipping costs. MakCameras accepts no liability for loss or damage occurring in transit when using your own delivery service.
9.5 All returns must include a copy of the sales invoice and must clearly display the returns authorisation number.
9.6 Subject to clause 9.1, MakCameras reserves the right to issue a refund instead of a replacement, including for returns due to faults or where the Product(s) were not as described.
9.7 If you purchased a Product from MakCameras as part of a Trade, you may return it for a refund under this clause. The refund will include the cash value assigned to the Product(s) in the Trade. However, once the transaction is complete, the original Product(s) you sold to us will not be returned under any circumstances.
9.8 Reduced Products. Products sold at a discounted or reduced rate will only be eligible for a refund and will not be eligible for a like for like replacement.
10. Liability
10.1 MakCameras shall have no liability for any loss, damage, non-delivery, or mis-delivery of a parcel if such issues arise due to the negligence or fault of the customer.
10.2 MakCameras cannot be held responsible for any delay in transit, regardless of the cause.
10.3 Nothing in this agreement shall limit or exclude our liability in the following cases:
(I) death or personal injury caused by our negligence;
(II) fraudulent misrepresentation;
(III) breach of any term implied by the Consumer Rights Act 2015, where such terms cannot be lawfully excluded or limited;
(IV) liability under Part I of the Consumer Protection Act 1987;
(V) any other liability that, under applicable law, cannot be excluded or limited.
10.4 Subject to clause 10.1 and to the extent permitted by law, MakCameras shall not be liable for any indirect or consequential losses, including but not limited to loss of profit, revenue, contracts, data, goodwill, or similar losses. Any liability we may have for losses arising from an order shall not exceed the purchase price of the relevant product and is strictly limited to losses that were reasonably foreseeable at the time the order was accepted. Losses are considered foreseeable where they could reasonably be anticipated by both parties.
10.5 MakCameras shall not be liable for failure or delay in performing any contractual obligations due to events beyond our reasonable control.
10.6 Nothing in this agreement shall affect the statutory rights of consumers.
11. The Warranty on Products Which You Buy from MakCameras
11.1 If you are a consumer, the warranty period for your Product shall be:
(I) 3 months for contracts concerning used Products, or
(II) 3 months for all contracts with traders.
This warranty is subject to applicable law, the provisions of clause 10.1, and any Extended Product Protection purchased under clause 11.7. The warranty is non-transferable to a third party. All warranty-related repairs or replacements must be pre-approved and authorised by MakCameras.
11.2 For used Products, accidental damage and misuse are not covered by this warranty. The specific details of coverage and exclusions are outlined in this document. MakCameras reserves the right to repair or replace a Product under warranty.
11.3 Authorising the Return
11.3.1 If you have a complaint or need to return a purchase under warranty, you can contact us via email at Help@MakCameras.com, providing your name, order number, and a description of the issue. Alternatively, you can contact us through the Contact Us page.
11.3.2 You must contact us before returning any Products under the MakCameras warranty to obtain a returns authorisation number. A copy of your sales invoice should also be included with the return.
11.3.3 All Products returned as faulty will undergo a thorough inspection. If no fault is found, the Product will be returned to you. We reserve the right to decline a repair or replacement unless a genuine fault is established.
11.3.4 MakCameras reserves the right to offer a replacement Product if a repair is deemed unfeasible. For used Products, the replacement may have slight cosmetic differences from the original item purchased.
11.4 What Is Covered by the MakCameras Warranty
11.4.1 The warranty covers the costs of parts and labour required for repairs performed by an approved repair agent, provided that the fault occurred during normal usage within the warranty period.
You must contact us for approval before arranging any repair.
11.5 Specific Exclusions (What Is NOT Covered)
11.5.1 Consumable items, including batteries, are not covered by the warranty.
11.6 General Exclusions (What Is NOT Covered)
11.6.1 Normal wear and tear.
11.6.2 Faults caused by:
(I) Repairs or cleaning performed by unauthorised personnel,
(II) Impact damage or any similar faults,
(III) Shock, falls, sand, dust, dirt, damp, corrosion, leaking batteries, fire, theft, vandalism, liquid damage or attempted theft,
(IV) Damage due to war, terrorism, mould, frost, flooding, or extreme weather conditions.
11.6.3 Accidental damage, including but not limited to:
(I) Inclusive but not limited to: faults caused by improper use, storage, or handling, failure to follow instructions provided by MakCameras or the manufacturer, or damage due to wilful neglect or negligence by anyone other than us,
(II) Damage to components such as connector pins, which MakCameras determines to be the result of accidental damage or misuse.
11.6.4 Issues related to image sharpness in lenses where evaluation is subjective.
11.6.5 Faults in Products that cannot be repaired due to discontinued or unavailable replacement parts.
11.6.6 Damage caused by the use of unauthorised spare parts or consumables not recommended by the manufacturer or loss of quality, degradation of performance.
11.6.7 Faults caused by attaching unapproved accessories or fittings to the Product.
11.6.8 Faults resulting from repairs carried out by unauthorised technicians who are not designated by MakCameras.
11.6.9 Loss or corruption of stored data.
12. Errors and Omissions
We strive to ensure that all information provided on the Platform is accurate. However, if you notice any errors, please notify us via email through the Contact Us page, and we will correct the issue as soon as possible.
13. Personal Data and Effects
13.1 Before sending Products to MakCameras as part of a sale or trade, we strongly recommend that you delete all personal data stored on the device, including digital images, private information, and contact details.
13.2 MakCameras is not responsible for any personal, confidential, or private information that customers provide to us, either intentionally or unintentionally, in connection with the purchase or exchange of Products. We also do not accept liability for the security of such data.
13.3 Customers must remove all media storage devices and memory cards before sending Products to us. Any storage media, memory cards, or similar devices found upon receipt of a Product will not be returned. These items will be recycled or properly disposed of, and MakCameras will not accept responsibility for any such items sent in error.
13.4 MakCameras is not liable for any additional items sent to us that are not part of the relevant contract, whether sent knowingly or unknowingly. The responsibility for such items remains with the customer, and MakCameras is not obligated to return them.
14. Payments to You on Products Which You Sell to MakCameras
14.1 Payments are made via bank transfer (BACS). Once a contract is agreed, you will be contacted and prompted to enter a valid sort code and account number through a secure link for payments to a UK-registered account. Payment to accounts not registered in UK is not possible.
14.2 It is your sole responsibility to ensure that the payment details, including account number and sort code are accurate. We may send email or SMS prompts to verify the details provided, but this does not mean that we assume any responsibility for their validity. MakCameras will not be liable if you fail to receive a payment or suffer any loss due to incorrect, incomplete, or inaccurate payment details, including payments sent to the wrong recipient.
14.3 Failure to provide correct payment details when prompted may result in delays in payment. MakCameras is not responsible for any such delays. If you fail to provide correct payment details within three months of your item(s) being checked, MakCameras reserves the right to take ownership of your item(s) without further notification or payment. In the case of adjusted quotes, you must respond to the adjustment email within three months of its send date, either by accepting the quote or confirming in writing that you do not wish to proceed and providing your return address. If you do not respond, MakCameras reserves the right to take ownership of your item(s).
14.4 Some payment methods, including bank transfers, depend on third-party providers outside of our control. MakCameras is not responsible for any delays in receipt of payment due to the actions or inactions of such third parties. Payments may also be subject to security and validation checks, either by MakCameras or third-party providers.
14.5 In the event of an overpayment made to you by mistake, you agree to return the overpaid sum immediately to the MakCameras account provided.
15. Force Majeure
MakCameras shall not be liable for any failure to perform contractual obligations due to circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, acts of God, fire, floods, storms, pandemics, epidemics, industrial action, actions by Internet service providers, and decisions by governments or regulatory authorities.
16. No Text or Data Mining
16.1 You shall not conduct, facilitate, authorise, or permit any text or data mining or web scraping in relation to our Platform at https://www.MakCameras.com or any services provided via or related to the Platform. This includes, but is not limited to:
(I) Using or permitting the use of any robot, bot, spider, scraper, or other automated tool to access, obtain, copy, monitor, or republish any portion of the Website or its content.
(II) Employing automated analytical techniques to analyse text and data in digital form to extract information such as patterns, trends, and correlations.
(III) Conducting manual data scraping.
16.2 Clause 16.1 shall not apply where such restrictions cannot be lawfully enforced under applicable laws.
16.3 Unauthorised use of data from the Platform, including but not limited to pricing information and the model database, is strictly prohibited.
17. Severability Clause
If any provision of this Agreement is found to be invalid or unenforceable due to applicable laws or a final ruling by a competent court or authority, the remaining provisions shall remain in full effect.
18. Right to Refuse Service
MakCameras reserves the right to refuse service to any customer who engages in abusive, rude, or harassing behaviour towards employees. This includes, but is not limited to, verbal abuse, threats, or any form of harassment. Ensuring a safe and respectful environment for our employees is of utmost importance to MakCameras.
